No Gun Confiscations During Emergencies.

The House of Representatives overwhelmingly passed Emergency Powers legislation by a 322-99 vote. The bill (HR 5013) was introduced by Rep. Bobby Jindal (R-LA) and prohibits the confiscation of firearms in the aftermath of a major disaster or emergency. The bill contained a couple of limitations on this prohibition: 1. The seizure of a firearm can occur if possession of said weapon violates federal, state or local law; and 2. Firearms can be temporarily seized from gun owners when brought aboard a rescue vehicle. Finally, Jindal’s language would give aggrieved gun owners a cause of action in federal court to recover their firearms and would recompense victorious plaintiffs for their attorney’s fees.

Gun Seizure.

The Disaster Recovery Personal Protection Act of 2006 (H.R. 5013) would prohibit the confiscation of firearms in the wake of a natural disaster. This bill is a response to the illegal confiscating of firearms from the victims of Hurricane Katrina in August 2005.  Confiscating firearms from law-abiding citizens is a clear violation of the Constitution — the Second Amendment guarantees that our “right to keep and bear arms shall not be infringed.  The Senate adopted similar legislation as an amendment to the Homeland Security appropriations bill a few weeks earlier (see Senate Roll Call #205.)
