Iran Military Operations.
Representative Maurice Hinchey (DN.Y.) offered this amendment to the 2007 Defense appropriations bill (H.R. 5631). The amendment would bar any funds to initiate military operations in Iran unless it is in accordance with Article I, Section 8 of the Constitution, which delegates to Congress alone the power to declare war. The power to declare war belongs to Congress, not to the president, and that much power should not be in the hands of one man.Peace Action
PROHIBITING MILITARY ACTION AGAINST IRAN.
In June 2006, the Bush administration’s bellicose rhetoric
regarding Iran and its nuclear program grew to a fever pitch.
The public and some members of Congress grew concerned
that the president may have been considering a preemptive
military strike, and possibly a nuclear strike. Amendment 1072
to House Resolution 5631 addressed concerns that President
Bush might not seek congressional approval for such an attack.
The amendment would have prohibited the use of any funds
in the Defense Appropriations bill to undertake military action
against Iran. Rep. Maurice Hinchey (D-NY) sponsored this
amendment. Failed.PeaceMajority.org

Limiting Options with Iran.
The Hinchey (D-NY) amendment would have prohibited funds made available by the Defense Appropriations Act of 2007 to be used against
Iran in the absence of the adoption by Congress of a formal declaration of war. Such a restriction could endanger national security by preventing the use of force or other military capabilities to contend with the rising danger posed by Tehran’s Islamofascist regime in circumstances short of war or when it may not be possible to secure a formal declaration of war.
