The measure would establish criminal penalties equal to those that would apply if the injury or death occurred to a pregnant woman, regardless of the perpetrator’s knowledge of the pregnancy or intent to harm the fetus. The bill states that its provisions should not be interpreted to apply to consensual abortion or to a woman’s actions with respect to her pregnancy. The death penalty could not be imposed under this bill. Passed.

Final passage of the Graham (R-SC) bill to make it a crime to cause the death or injury of an "unborn child" who is "in utero." The bill would recognize for the first time, a zygote, blastocyst, embryo, or fetus as an independent victim of a crime, with rights separate and equal to those of a woman and worthy of legal protection. The House voted to impose criminal penalties for killing or injuring a "child who is in utero at the time the conduct takes place." The so-called "child" can be no more than a fertilized egg. This bill is just an updated version of the 1980''s "Human Life Amendment" to the Constitution, which would have declared that "life begins at conception," so abortion would be treated as a criminal act of murder.
