Resolution of Disapproval to Overturn Obama’s HHS Title X Rule.
Sponsored by Rep. Diane Black (R-Tenn.), this resolution of disapproval (H.J. Res. 43) overturned former President Barack Obama’s Department of Health and Human Services rule, finalized in December 2016, that prevented states from redirecting Title X family planning funds away from abortion providers like Planned Parenthood.

This resolution invokes the Congressional Review Act to overturn an Obama Administration rule that forces states to send taxpayer funds for “family planning,” known as Title X funds, to Planned Parenthood. This group believes abortion is a human tragedy and opposes sending taxpayer funds to organizations that perform abortions, such as Planned Parenthood, and supported this resolution. The House passed the resolution.

A resolution to express congressional disapproval of the final rule relating to compliance with Title X requirements, H.J.Res.43. Final Passage. This measure would reverse the Obama administration rule prohibiting discrimination against healthcare providers in the Title X program. Passed.
National Right to Life Committee
Nullification of Obama pro-abortion Title X rule.
Title X of the Public Health Service Act is a major federal "family planning" program, currently funded at about $286 million annually. In 2016, the Obama Administration issued a regulation to prevent states from redirecting funds away from Title X away from providers deemed unsuitable, such as Planned Parenthood. Under a law called the Congressional Review Act, Congress has the ability to nullify such agency regulations under certain circumstances. H.J.Res. 43, sponsored by Rep. Diane Black (R-Tn.), employed Congressional Review Act authority to nullify the Obama Title X regulation, and thereby restore the previous authority of states to direct Title X funds to providers that they deem suitable. This group supports H.J. Res. 43. In the roll call shown here, the pro-life resolution passed the House. The Senate also approved H.J. Res. 43. It was signed into law by President Trump.

Federal Family Planning.
This legislation (House Joint Resolution 43) would disapprove of and nullify a Health and Human Services Department (HHS) rule that prevents states from restricting federal family planning funding to a health provider, such as denying funds to a center that provides abortions, for any basis other than its ability to provide health services. Under the current rule, HHS can withhold family planning grants to any state that restricts the participation of a health provider in the family planning services grant program.
The House passed H.J. Res. 43. This group supported this bill because it limits the power of an unconstitutional federal government agency. The U.S.Constitution does not authorize the federal government to get involved in healthcare, much less establish a Department of Health and Human Services, so any attempt to limit the power of an unconstitutional federal agency is a step in the right direction.
