S.J. Res 26 Disapproval of EPA Greenhouse Gas Rule.
Senate Joint Resolution 26 proposed by Senator Lisa Murkowski. This resolution of disapproval is in response to the U.S. Environmental Protection Agency’s (EPA) plans to introduce a host of new greenhouse gas regulations under the Clean Air Act. Allowing the EPA to move forward with regulatory action on greenhouse gas emissions without first obtaining a legislative mandate from Congress is inappropriate and will impede economic recovery. The resulting permitting delays and increased energy and materials prices will hamper much-needed construction projects and contribute to unnecessary job loss. Vote to proceed failed, bill saw no further action.

Global warming is the central environmental challenge of our time. In 2007 in Massachusetts v. EPA, the Supreme Court ruled that global warming pollutants were covered by the Clean Air Act and directed the EPA to determine whether the continued emission of such pollutants endangered the country’s public health and welfare. In December 2009, the EPA issued this “endangerment finding,” concluding that, based on the best science, global warming pollution presents a clear threat to public health and welfare. The endangerment finding was the scientific determination necessary to allow the agency to start limiting global warming pollution under the Clean Air Act.

In January, Senator Lisa Murkowski (R-AK) introduced a Congressional Review Act disapproval resolution (S.J. Res. 26) that would overturn EPA’s endangerment finding. The resolution would prevent the EPA from taking the necessary steps under the Clean Air Act to address global warming pollution. In particular, the resolution would dismantle the clean vehicles standards negotiated by the Obama administration and supported by the auto industry, labor, states, and environmentalists, putting at risk standards that are estimated to save 1.8 billion barrels of oil over the lifetime of the program. In addition to blocking the clean cars standards, the resolution would have blocked new commonsense safeguards to protect the air we breathe and the water we drink from global warming pollution from some of our country’s biggest polluters. The Senate defeated S.J. Res. 26.

A resolution offered by Sen. Murkowski (R-AK) would have overturned the Environmental Protection Agency’s “endangerment finding” on greenhouse gas emissions. The resolution would have prevented EPA from regulating greenhouse gas emissions to address the serious problem of global warming. It also threatened to unravel the historic agreement on one national standard for fuel economy and greenhouse gas emissions for cars and light trucks that was negotiated by the Obama administration and all key stakeholders and the auto companies. Fortunately, the Senate rejected a motion to proceed to debate on the Murkowski disapproval resolution, thereby killing this dangerous measure.

This legislative measure (Senate Joint Resolution 26) would disapprove an Environmental Protection Agency endangerment finding that greenhouse gases may be regulated as pollutants under the Clean Air Act. The EPA had issued the finding in December 2009, claiming that “six greenhouse gases taken in combination endanger both the public health and the public welfare of current and future generations.” The supposedly dangerous pollutants include carbon dioxide, even though this natural substance is necessary for the existence of plant life. A motion to consider Senate Joint Resolution 26 was rejected by the Senate.
