The Senate killed an amendment that would have imposed a one year moratorium on congressional earmarked spending provisions.

Rockefeller D-W.Va. motion to table (kill) the DeMint R-S.C. amendment no. 3454 to the Rockefeller substitute no. 3452. The DeMint amendment would provide for a point of order against consideration of legislation containing congressionally-directed spending items in fiscal 2010 and 2011. The substitute would authorize $34.5 billion for the Federal Aviation Administration through fiscal 2011. It would codify and accelerate completion timelines for a new satellite-based air traffic control system and would require the FAA to maintain a comprehensive database of pilot performance records. Air carriers and airports would be required to submit proposed contingency plans for long on-board tarmac delays. It would increase the general aviation jet fuel tax at a rate of 36 cents per gallon and subject fractional aircraft to the tax rate.
